1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of the Sunset Chasers mobile application and its associated administrative web panel (together, the “Services”), operated by Sunset Chasers LLC (“we,” “us,” or “our”). By creating an account or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.

2. Description of the Service

The App helps users discover nearby sunset-viewing locations based on their current location and real-time sunset and weather data. Users can browse spots on an interactive map or list, contribute new spots with photos or videos, rate and review locations, save favorites, and receive notifications ahead of the optimal viewing time. An administrative web panel allows authorized personnel to manage users, submissions, and static content.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, if higher) to create an account. By using the Services, you represent that you meet this requirement and that any information you provide during registration is accurate and truthful.

4. Accounts & Registration

  • You may register using an email address, phone number, and password, or by signing in with a supported third-party account (Google or Apple).
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
  • You agree to notify us promptly of any unauthorized use of your account.
  • We reserve the right to activate or deactivate accounts, at our discretion, for violations of these Terms or the Acceptable Use section below.

5. Subscription Tiers, Free Trial & Payments

The Services are offered under a tiered access model:

  • Free Trial (7 days): new users may view sunset pins submitted by others for a limited trial period.
  • Member (free): after the trial, users may continue to view and explore public sunset pins at no cost.
  • Contributor (paid): a paid subscription tier that unlocks full access. Dropping new pins, uploading photos and videos, rating and reviewing spots, sorting favorites, and viewing review visibility.
  • Payments for the Contributor tier are processed through Apple Pay or Google Pay, in accordance with the applicable app store’s billing terms. Subscriptions renew automatically unless canceled before the renewal date through your app store account settings. Fees are non-refundable except where required by law or by the applicable app store’s refund policy. We reserve the right to change subscription pricing on reasonable notice; continued use after a price change constitutes acceptance of the new pricing.

6. User-Generated Content & License

“User Content” means any pins, location names, descriptions, photos, videos, ratings, or reviews you submit through the Services.

  • You retain ownership of your User Content, but by submitting it you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute it in connection with operating and promoting the Services.
  • Map pins are always public. The location name and coordinates of any pin you drop will be visible to all users, regardless of the privacy setting applied to associated photos or videos.
  • Photos and videos may be marked public or private at your discretion, but private does not mean confidential. It limits visibility to your followers/members within the app, not to us or to legal process.
  • You are solely responsible for your User Content and represent that you own it or have the necessary rights to submit it, and that it does not infringe any third party’s rights.
  • We may remove or disable access to any User Content, at our discretion, that we believe violates these Terms, applicable law, or the rights of others.

7. Acceptable Use & Prohibited Conduct

When using the Services, you agree not to:

  • Submit false, misleading, or duplicate sunset spot listings;
  • Upload content that is unlawful, defamatory, obscene, harassing, or that infringes another person’s intellectual property or privacy rights;
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • Use the Services to collect or harvest personal information about other users;
  • Attempt to reverse-engineer, decompile, or interfere with the operation or security of the Services;
  • Use automated means (bots, scrapers) to access the Services without our written permission;
  • Post reviews or ratings that are fraudulent, incentivized without disclosure, or intended to manipulate a spot’s average rating.
  • Violations may result in content removal, account suspension, or termination, at our discretion.

8. Location Services

Core features of the App depend on access to your device’s location. You may disable location permissions at any time through your device settings, but doing so may limit or disable your ability to discover nearby spots, submit new pins, or receive directions. “Get Directions” functionality redirects you to Google Maps for full navigation; we are not responsible for the accuracy of third-party routing or navigation.

The Services integrate with third-party providers, including Google Maps (mapping and directions), OpenWeather (sunset timing and weather data), Firebase Cloud Messaging / OneSignal (push notifications), and Apple Pay / Google Pay (payment processing), and support sign-in via Google and Apple. These providers operate under their own terms and privacy policies, which we encourage you to review. We do not control and are not responsible for the accuracy, availability, or performance of third-party services, including the accuracy of sunset timing or weather predictions, which may vary from actual conditions.

10. Our Intellectual Property

The Services, including their design, logos, trademarks, and underlying software (excluding User Content), are owned by Sunset Chasers LLC or its licensors and are protected by intellectual property laws. Except for the limited license to use the Services as intended, no rights are granted to you in our intellectual property.

11. Disclaimers

The Services, including sunset timing, weather conditions, and location listings, are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee the accuracy, completeness, or timeliness of any sunset timing, weather data, or user-submitted location information. Sunset spots are user-contributed and may involve travel to unfamiliar, remote, or physically challenging locations. You use any location or directions at your own risk, and you are responsible for assessing conditions such as terrain, weather, and safety before visiting any spot.

12. Limitation of Liability

To the maximum extent permitted by law, Sunset Chasers LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including personal injury or property damage arising from your use of a sunset spot, or loss of profits or data, arising out of or related to your use of the Services. Our total liability for any claim arising from these Terms or the Services shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Sunset Chasers LLC, its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, your User Content, or your violation of these Terms.

14. Suspension & Termination

  • We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or exposes us to liability.
  • You may stop using the Services and delete your account at any time via account settings or by contacting us.
  • Provisions that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability, indemnification) will survive.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Nevada, United States, without regard to its conflict-of-laws principles, and this governing law applies to all users regardless of the state or country from which they access the Services. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state or federal courts located in Nevada.

16. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms within the App’s Static Content section and update the “Last Updated” date above. Material changes may also be communicated via in-app notice or email. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
