1. Introduction
Sunset Chasers LLC (“we,” “us,” or “our”) operates the Sunset Chasers mobile application (the “App”) and its associated administrative web panel (together, the “Services”). The App helps users discover nearby sunset-viewing locations based on their current location and real-time sunset and weather data, and lets users contribute new spots, photos, and reviews to a shared community database.
This Privacy Policy explains what information we collect, how we use and share it, and the choices you have. By creating an account or otherwise using the Services, you agree to the practices described here.
2. Information We Collect
2.1 Information you provide directly
- Account information: first & last name, email address, phone number, password, username, and profile picture, collected when you sign up with email/password or through social sign-in.
- Accessibility information: a self-selected disability type from a pre-defined list, collected on the sign-up form.
- Social sign-in data: basic profile information from Google or Apple, as permitted by those providers, when you sign up or sign in with a social account.
- User-generated content: sunset spot submissions, location names, descriptions, photos, videos, star ratings, and written reviews, collected whenever you add a new spot, leave a review, or favorite a location.
- Payment information: your subscription tier and transaction confirmation, collected when you subscribe to the paid “Contributor” tier (payments are processed by Apple Pay / Google Pay — we do not store card numbers).
- Communications: support requests and feedback submitted through the app, collected whenever you contact us.
2.2 Information collected automatically
- Location data: your device’s real-time or approximate location, used to show your position on the map and find nearby sunset spots.
- Usage data: favorites, contributions, ratings given, badges earned, sorting preferences, and general in-app activity.
- Device data: device type, operating system version, unique device identifiers, and mobile network information, primarily for app performance monitoring and push notifications.
3. Location Information
Location access is central to the App’s core function of finding nearby sunset-viewing spots. With your permission, we use your device’s GPS to:
- Show your current position on the interactive map;
- Identify and rank nearby sunset spots and their optimal viewing windows;
- Auto-fetch geo-coordinates when you drop a pin to submit a new spot;
- Provide directions via Google Maps when you tap “Get Directions.”
- You can disable location access at any time in your device settings, though this will limit or turn off core discovery features. Location data attached to a submitted pin is always public, as described in Section 8.
4. How We Use Your Information
- To create and manage your account and authenticate you at sign-in;
- To operate core features: map display, spot discovery, favorites, contributions, ratings and reviews;
- To provide real-time sunset timing and weather information at your location or a selected spot;
- To send push notifications (e.g., 30–60 minutes before an ideal sunset time, or account and community activity updates);
- To process subscription payments and manage your free trial and Contributor-tier access;
- To award badges and track contribution milestones;
- To communicate with you about your account, support requests, or policy changes;
- To monitor app performance, diagnose crashes, and improve the Services;
- To enforce our Terms & Conditions and detect misuse, fraud, or abusive content.
5. Legal Basis for Processing
Where required by law, we process your information on the following bases: performance of a contract (providing the Services you signed up for), your consent (e.g., location access, marketing communications, disability-type disclosure), our legitimate interests (app security, fraud prevention, service improvement), and compliance with legal obligations.
6. How We Share Information
We do not sell your personal information. We may share information with:
- Other users: your name/profile (if public), submitted spots, photos/videos marked “public,” and reviews are visible to the community.
- Service providers: cloud hosting, analytics, customer support, and the third-party providers listed in Section 7, who process data on our behalf under appropriate agreements.
- Legal & safety purposes: where required to comply with law, enforce our terms, or protect the rights, property, or safety of Sunset Chasers LLC, our users, or the public.
- Business transfers: in connection with a merger, acquisition, or sale of assets, subject to standard confidentiality protections.
7. Third-Party Services
The App integrates with the following third-party services, each governed by its own privacy policy:
- Google Maps: interactive map display, nearby-spot markers, and turn-by-turn directions.
- OpenWeather: real-time sunset timing and weather condition data.
- Apple Pay / Google Pay: processing subscription payments.
- Firebase Cloud Messaging (FCM) / OneSignal: delivering push notifications.
- Google Sign-In / Apple Login: social authentication and account creation.
We encourage you to review these providers’ privacy policies to understand how they handle your information.
8. Public & User-Generated Content
The App is built around a community-contributed database of sunset spots. Please be aware:
- Map pins you drop, along with the location name and coordinates, are always public and visible to all users, regardless of any privacy setting applied to associated media.
- Photos or videos you upload can be marked public (visible to everyone) or private (visible only to your followers/members), at your choice.
- Your name or profile may be displayed publicly as the contributor of a spot, if you have made it visible.
- Ratings and written reviews you submit may be visible to other Contributor-tier users.
- Do not include sensitive personal information in public submissions, descriptions, or reviews.
9. Data Retention
We retain account and content data for as long as your account remains active, or as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. If you delete your account, we will delete or anonymize your personal information within a reasonable period, except where retention is required by law or where content (such as public spot submissions) has already been made public and is retained in anonymized form to preserve the community database’s integrity.
10. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect your information, including secure storage of passwords and monitored infrastructure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
11. Your Rights & Choices
Access & correction: review and update your profile information in “My Account.”
- Deletion: request deletion of your account and associated personal data by contacting us.
- Location permissions: enable or disable location access via your device settings.
- Push notifications: opt out at any time via your device or in-app notification settings.
- Marketing communications: unsubscribe from non-essential emails using the link provided in each message.
- Regional rights: depending on your location, you may have additional rights, such as data portability, restriction of processing, or objection to processing, under applicable law. Contact us to exercise these rights.
12. Children’s Privacy
The Services are not directed to children under the age of 13 (or the applicable minimum age in your jurisdiction), and we do not knowingly collect personal information from children. If we learn that we have collected personal information from a child without appropriate consent, we will delete it promptly.
13. Sensitive Information
During sign-up, users are asked to select a “Type of Disability” from a pre-defined list. This is a category of sensitive personal information under many privacy laws. We collect it only with your explicit consent, use it solely to filter and recommend sunset spots that are suitable for your accessibility needs, and do not use it for advertising or profiling. You may decline to provide this information where the sign-up flow permits, subject to any resulting limitations on account features.
14. International Data Transfers
Your information may be processed and stored on servers located outside your country of residence. Where we transfer personal data internationally, we use appropriate safeguards as required by applicable law (such as standard contractual clauses).
15. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the revised policy in the App’s Static Content section and update the “Last Updated” date above. Material changes may also be communicated via in-app notice or email.
